On Thursday, April 2, 2015, our office was called in regard to two Power of Attorney documents needing signing and witnessing at Heartland HCR Manorcare West, 600 Sulphur Springs Road, Greenville, South Carolina 29617. The signing did occur on Friday, April 3, 2015 at Noon. Needless to say, this was ONE TOUGH ASSIGNMENT as three different situations occurred. First, an additional witness had to be found. Upon entering the facility there were family members of another party waiting for their loved one to return. One of the parties obliged our request, so then the wheels were set in motion. Situation #2, the signer’s license was expired, therefore two affiant statements by her family members were completed. Finally, someone had to sign on the mother’s behalf due to her physical inability to sign. In the State of South Carolina a notary public CAN sign on behalf of a signer who is physically unable to do so. Keep in mind, just because a signer cannot PHYSICALLY sign, does not mean that they are incompetent and do not have sound mind.
